Terms & Conditions

1. Scope

These terms govern access to and use of the Energie Software platform, including the customer portal, staff back-office, and any associated APIs (collectively, the "Platform"). By accessing the Platform you agree to these terms.

2. Platform Access

Access to the Platform is granted to licensed energy suppliers operating in the Benelux region and their authorised staff. The demo environment is available to prospective customers for evaluation purposes only.

3. Data Processing

The Platform processes energy consumption data, customer personal data, and financial data on behalf of the energy supplier (data controller). Energie Software acts as data processor in accordance with GDPR (Regulation (EU) 2016/679). A Data Processing Agreement is required before production access is granted.

4. Acceptable Use

You may not:

  • Use the Platform to process data for any entity other than the licensed label(s) covered by your agreement.
  • Attempt to reverse-engineer, decompile, or extract the Platform's source code.
  • Transmit false or misleading data to EDSN or any market party via the Platform.
  • Share access credentials with unauthorised parties.
5. Service Levels

Target platform availability is 99.5% monthly, excluding scheduled maintenance windows. Scheduled maintenance is communicated at least 48 hours in advance via email. SLA terms are set out in the individual service agreement.

6. Liability

Energie Software is not liable for financial loss arising from incorrect data submitted by the customer, regulatory changes affecting billing calculations, or third-party service outages (EDSN, Belastingdienst, bank clearing systems). Total liability is capped at the fees paid in the 12 months preceding the claim.

7. Governing Law

These terms are governed by Dutch law. Any disputes shall be submitted to the competent court in Amsterdam, the Netherlands.

8. Changes

We may update these terms. Customers will be notified by email at least 30 days before material changes take effect. Continued use of the Platform after that date constitutes acceptance of the updated terms.
